Los Angeles Medical Malpractice Lawsuit Filed After Woman Dies Following Lap Band Surgery

A Simi Valley man and his daughter have filed a Lap-Band lawsuit alleging medical malpractice and wrongful death in Los Angeles County Superior Court as the result of the death of Laura Faitro following Lap-Bank weight loss surgery.

Here, Faitro underwent the Lap-Band surgery at Valley Surgical Center in West Hills and was discharged the same day despite her complaints of severe abdominal pain. Consumers Question Whether Los Angeles Medical Errors Are Under Reported

The Los Angeles Times reports that state officials are giving several hospitals in L.A. and throughout California until Tuesday to verify reports that no significant medical errors have occurred in the last three years at the hospitals.

More than 20% of the state's hospitals have reported no errors have occurred than might put a patient at risk of death or serious injury. When medical errors such as failures to diagnose, prescription errors and inadequate patient monitoring occur, the results can be catastrophic and may constitute medical malpractice.

Under California law, hospitals are required to notify health officials within five days if any of 28 errors occur. As a result of the reporting, the state may impose fines and also look for ways to improve hospital safety and prevent these incidents from happening again. Although it would be a positive step in patient safety if no errors occurred, many are skeptical that the reporting of no errors is inaccurate.
